ELLERBE — A homeless woman is facing a pair of assault charges following an incident on Wednesday.
One arrest warrant alleges that 36-year-old Brittany Nicole Daly, who is listed as being homeless, went to a McIntyre Road residence on Feb. 17 and stayed after being told not to be there.
Daly allegedly pushed a female resident into a door frame, causing bleeding and bruising.
(NOTE: The warrant states that the alleged trespassing occurred on Feb. 17, but the incident date listed as Feb. 18. The reporting victim also has the same last name as the defendant.)
Daly is also accused of pushing a male victim in the arm, which resulted in bruising.
Warrants, taken out by the reporting victims, charging Daly with two counts of assault and battery and one count of second-degree trespassing were issued Feb. 18 and she was arrested Feb. 19.
Daly was booked into the Richmond County Jail on a combined $1,500 secured bond and is scheduled to appear in court March 2.
According to the release orders, Daly has a history of “assaultive and threatening behavior” towards the initial reporting victim “and appears to not be stopping,” as well as issues with mental health, drugs and homelessness.
If or when she is released on bail, Daly is ordered to not be on the property or have contact with either reporting victim.
Records with the N.C. Department of Adult Correction show Daly has the following previous criminal convictions:
2009 - two counts of assault and battery
2016 - two counts of possession with intent to sell a Schedule II controlled substance; violation of a protective order; resisting a public officer
2017 - unauthorized use of motor conveyance
2018 - communicating threats
2020 - larceny of a motor vehicle; misdemeanor larceny
Online court records show Daly was also convicted in 2024 of simple assault and resisting a public officer, and misdemeanor crime of domestic violence.
She was also convicted in 2023 of violating a protective order, assault and battery, and interfering with emergency communication; and in 2022 of a protective order violation.
All defendants facing criminal charges are presumed innocent until proven guilty in a court of law.
